1. About These Terms
These Terms and Conditions (“Terms”) apply whenever you make a booking with Kite and Compass Travel Ltd (“Kite and Compass”, “we”, “us” or “our”). By paying a deposit or otherwise confirming a booking with us, you (“you” or “the customer”), as the lead booker, agree to these Terms on behalf of yourself and everyone included in the booking.

These Terms apply in addition to, and do not replace, the booking conditions of InteleTravel UK and of the individual supplier(s) or organiser(s) providing your travel arrangements. Where there is a conflict between these Terms and a supplier's or organiser's own conditions, the supplier's or organiser's conditions will govern the travel service itself, and these Terms will continue to govern your relationship with Kite and Compass.

The current version of these Terms is published on our website at kiteandcompasstravel.co.uk and is linked in the website footer. That website version is the source of truth. The version of these Terms in force at the time you pay your deposit is the version that applies to your booking; later updates to these Terms do not retrospectively change a booking you have already made.
2. Who We Are
Kite and Compass Travel Ltd is a private limited company registered in England and Wales, company number 17327689. Our registered office is Collingwood Buildings, 38 Collingwood Street, Newcastle Upon Tyne, NE1 1JF.

Kite and Compass Travel Ltd is an independent travel advisor under InteleTravel UK, ABTA membership P7384. InteleTravel UK are appointed agents of our ATOL-protected suppliers.

We are not ourselves a member of ABTA and we do not hold our own ATOL licence. We are not authorised or regulated by the Financial Conduct Authority.
3. Our Role
We help you plan and book travel arrangements. Depending on what you book, we act in one of two ways:

Package arrangements: we may put together a bespoke combination of travel services (for example flights, accommodation, transfers and excursions) drawn from our network of preferred suppliers.

Agency arrangements: we may sell, on an agency basis, travel services or holidays created and organised by an individual supplier or tour operator.

For every booking, the party acting as organiser (the entity legally responsible for the performance of the package under the Package Travel and Linked Travel Arrangements Regulations 2018) and/or as merchant of record (the entity that takes your payment) will be identified in your booking confirmation and supporting documentation. That party's own booking conditions govern the performance, amendment, cancellation and financial protection of the travel arrangements you have booked. Kite and Compass is not itself the organiser or merchant of record unless your booking documentation expressly says so.

Kite and Compass does not take, hold or process customer payments. When you are ready to pay a deposit or balance, we will direct you to a secure payment link generated by InteleTravel UK. Booking confirmations are issued by the relevant supplier and/or InteleTravel UK.
4. Financial Protection
Where your booking is a package that includes flights, the applicable ATOL protection is provided by the ATOL-holding supplier, and InteleTravel UK acts as an appointed agent of that supplier. Where a booking is required to carry an ATOL Certificate, this should be issued and reach you at the time your first payment is accepted; please check that you have received one and contact us if you have not.
Financial protection for a package that does not include a flight (for example bonding, insurance-backed trust arrangements, or protection provided through InteleTravel's ABTA arrangements) depends on the particular booking. The protection that applies to your booking will be confirmed in your booking documentation. If you are unsure what protection applies to your arrangements, please ask us or refer to ABTA's guidance before you pay.
Because financial protection can depend on exactly how your booking is structured, we strongly recommend that you also take out adequate travel insurance (see clause 12).
5. Eligibility to Book
To make a booking with us, the lead booker must be at least 18 years old and must have the authority of everyone else included in the booking to make that booking and to accept these Terms and the applicable supplier terms on their behalf.
We work with leisure and business travellers, including solo travellers, couples, families, groups, honeymoons and weddings. Some suppliers may apply their own eligibility criteria (for example minimum age requirements for certain trips), which will be made clear before you book.
6. Making a Booking, Quotes and Prices
Before you pay a deposit, all quotations, itineraries, prices and availability we provide are provisional and may change. Prices and availability are not guaranteed and can be affected by matters outside our control, including supplier pricing, exchange rates and demand.

Your booking is confirmed, and you are committed to it, when you pay the required deposit through the InteleTravel payment link. Once your deposit is paid, we register the booking with InteleTravel, which secures our commission from the relevant supplier(s).

All prices are quoted and payable in pounds sterling (GBP).
7. Deposits, Balance Payments and Late Payment
The deposit amount and the final balance due date for your booking are set by the relevant supplier and/or InteleTravel UK, not by Kite and Compass, and will be confirmed to you in your booking documentation. You must pay by the dates given to avoid the risk of your booking being cancelled and any associated cancellation charges being applied by the supplier.

Kite and Compass does not charge any separate cancellation, amendment, consultancy, planning or administration fee. Any such charges that do apply to your booking are set and charged by the relevant supplier and/or InteleTravel UK under their own terms, and will be passed on to you transparently.
8. Errors in Prices or Booking Details Before Confirmation
Occasionally a price or other detail may be quoted in error before your booking is confirmed, for example because of a supplier pricing error or a data-entry mistake. If we or you identify a suspected error before your deposit is paid, we will raise it with the relevant supplier and work with them to resolve it before proceeding. We do not have a general right to unilaterally change a confirmed price; any change to a price already confirmed can only happen in the circumstances permitted under the applicable supplier or organiser terms.
9. Your Information
You are responsible for ensuring that all information you give us is accurate and up to date, including names exactly as they appear on passports, dates of birth and contact details. We pass this information to the relevant suppliers and, where relevant, to InteleTravel UK, in order to process your booking.
Kite and Compass will not be responsible or liable for any cost, charge or penalty that arises because information you provided was incorrect, incomplete or out of date.
Please check your booking confirmation and other travel documents as soon as you receive them. If anything is wrong, including names, dates, room types, flight details or destinations, you must tell us as soon as possible so that we can help you get it corrected.
10. Passports, Visas, Health and Entry Requirements
We provide standard guidance on passport, visa, vaccination and other entry requirements as part of your booking documentation. However, it is your responsibility to check and comply with the passport, visa, health and other entry requirements that apply to you and everyone in your party for your specific trip, including requirements that may differ by nationality. Requirements can change after booking, so please check again closer to departure.
11. Special Requirements, Medical Conditions and Accessibility
If you or anyone in your party has a medical condition, disability, reduced mobility, dietary requirement or other need that may affect your trip, please tell us before you book so that we can check with the relevant suppliers whether it can be accommodated.

We will pass any special request to the relevant supplier, but we cannot guarantee that it will be met unless the supplier has expressly confirmed it in writing. This includes requests such as adjoining rooms, particular seating, dietary preferences, room location, early check-in, wedding arrangements or accessibility needs.
12. Travel Insurance
We strongly recommend that you take out adequate travel insurance for your trip, appropriate to your destination, activities and any pre-existing medical conditions. Arranging suitable insurance is your responsibility.
We can introduce you to travel insurance products offered by our approved third-party insurance suppliers. If you buy insurance this way, you are contracting with the insurer or insurance provider, and Kite and Compass is simply facilitating that introduction. Kite and Compass Travel Ltd is not itself authorised by the Financial Conduct Authority to sell or advise on insurance.
Where you choose not to take out travel insurance, we will record that insurance was recommended to you. Kite and Compass will not be liable for any cost, loss or expense that arises because you did not have adequate travel insurance in place, except to the extent that liability cannot lawfully be excluded.
13. Optional Activities and Experiences
We can plan and add activities and experiences as part of your overall trip, in which case they form part of your booked arrangements and are covered by the terms applicable to that booking.
We can also arrange a standalone activity or experience, such as a safari day trip, theatre ticket or guided tour, without accommodation or transport being booked at the same time. Where you book in this way, we strongly recommend also booking your transport and accommodation with us, and the protections that apply to a standalone activity may differ from those that apply to a full package. This will be made clear at the time of booking.
14. Changes to Your Booking by the Supplier or Organiser
Kite and Compass does not independently alter the price or content of a confirmed booking. If the organiser, InteleTravel UK or a supplier makes a change permitted under their own booking terms (for example a schedule change, itinerary amendment or price adjustment), we will pass that information on to you promptly and help you understand the options available to you under the applicable terms.
If a supplier changes or cancels part of your booking, such as a hotel, flight, transfer or excursion, we will act as your point of contact and help you pursue the remedy available. The actual entitlement to a refund, replacement or compensation depends on the relevant supplier's terms and any statutory rights that apply, such as those under the Package Travel and Linked Travel Arrangements Regulations 2018.
15. Our Role During Your Trip
We are your primary point of contact before, during and after your trip, because we made the booking with you. We will provide reasonable assistance if something goes wrong, which may include signposting you to the relevant supplier's or organiser's own contact details.

We do not currently offer a guaranteed 24-hour emergency contact service. At present, Kite and Compass is a small operation and we will respond to enquiries as promptly as we reasonably can. For urgent matters outside our normal working hours, you may need to contact the relevant supplier's own emergency assistance line directly, details of which will be included in your booking documentation.
16. If Something Goes Wrong While You Are Travelling
If a problem arises during your trip, please report it to the relevant supplier locally as soon as possible, so that they have the opportunity to put things right, and let us know as soon as reasonably possible so that we can help. Prompt reporting gives everyone the best chance of resolving the issue while you are still travelling.
17. Complaints
If you remain unhappy after your trip, please contact us in the first instance and we will do what we can to help resolve the matter. If a complaint remains unresolved, we will refer you to ABTA, whose reference number for InteleTravel UK (P7384) is set out in your booking documentation, so that you can pursue the matter further where ABTA's scheme applies to your booking.
18. Customer Conduct
We ask that you and everyone in your party behave reasonably and lawfully towards our staff, suppliers and other travellers. If you or a member of your party behaves in a way that is abusive, threatening, unlawful, or that seriously disrupts the trip, we reserve the right to stop providing assistance to you. Any decision to terminate your travel arrangements themselves will be a matter for the relevant supplier or organiser under their own terms and applicable law.
19. Events Outside Anyone's Control
Neither Kite and Compass nor any supplier or organiser can be held responsible for failure to perform, or delay in performing, any obligation caused by events outside their reasonable control. This includes, without limitation, severe weather, natural disasters, strikes or industrial action, war or the threat of war, terrorism, epidemic or pandemic, government action, and transport disruption.
Where such an event affects a booking that is ATOL protected, ATOL protects you against the financial failure of the relevant ATOL holder; it does not provide general protection against disruption, cancellation or similar events. We will help put you in touch with the appropriate party, including facilitating initial communication with the relevant ATOL holder or the Civil Aviation Authority where relevant, but your rights in these circumstances will depend on the applicable supplier or organiser terms and any statutory rights that apply.
20. Our Liability to You
To the fullest extent permitted by law, Kite and Compass's liability to you is limited as follows:

We are not liable for the acts or omissions of any supplier, organiser, InteleTravel UK, or any other third party involved in providing your travel arrangements, except to the extent that we have been negligent in our own role of introducing, arranging or facilitating your booking.

We are not liable for any loss or cost arising from information you provided that was inaccurate, incomplete or out of date.

We are not liable for events outside anyone's reasonable control, as described in clause 19.

We are not liable for any indirect or consequential loss.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited under English law, including relevant statutory rights under the Consumer Rights Act 2015 and the Package Travel and Linked Travel Arrangements Regulations 2018.
21. Website Use and Intellectual Property
Our website, kiteandcompasstravel.co.uk, is provided for general information, including details of our services and offers. It is not a booking platform: bookings are not made directly through the website but are handled personally, usually after you submit a customer profile enquiry form.
All content on our website and in our marketing materials, including text, images, video and branding, is owned by Kite and Compass Travel Ltd or used under licence, and may not be copied or reused without our permission.
22. Privacy and Data Protection
We take your privacy seriously. Details of how we collect, use and share your personal data, including with InteleTravel UK, suppliers, insurers and other parties necessary to fulfil your booking, are set out in our separate Privacy Policy, available on our website.
23. Other Applicable Terms
Your booking is also governed by the booking conditions of InteleTravel UK and of the relevant supplier(s) or organiser(s), which will be provided or referred to as part of your booking documentation. Those terms take priority over these Terms in relation to the performance of the travel arrangements themselves, including matters such as changes, cancellations, refunds and financial protection.
24. Changes to These Terms
We may update these Terms from time to time. The current version will always be available on our website, linked in the footer. The version in force at the time you pay your deposit is the version that applies to your booking, and later changes will not be applied retrospectively to a booking already made.
25. Governing Law and Jurisdiction
These Terms, and any dispute arising from them, are governed by the law of England and Wales. Any dispute will be dealt with by the courts of England and Wales, without prejudice to any mandatory consumer protection rights you may have.
We currently accept bookings from UK-resident customers only.
